Clearing along Lilipuna Drive upsets neighbors

When the condominiums where built on the hill above Lilipuna Road, the developer was required to plant trees which would screen the condominiums from their neighbors and would maintain the character of a green hillside when viewed for afar.

The requirements are based on Ordinance 4421 which gives the county the right to establish Planned Development Areas.

The condominium owners have no legal right to a view of the bay, but they do have an obligation to maintain a vegetative screen between themselves and their neighbors.

What they have done is to top the trees and prune them to the point that they have a view of the bay and their neighbors have a view of them

The city has told the condominium association that they cannot cut any tree and they cannot trimb any tree without a C&C approved landscaping plan prepared by a landscape architect.
